Animal Cruelty

Practice Description

False accusations in animal cruelty cases occur quite often. Frequently, charges come from neighbors who report individuals to animal control for perceived neglect or abuse. This leads to innocent people getting arrested or ticketed without a full investigation into all the facts surrounding the case.

Most signs of animal abuse or neglect are much more severe than a dog constantly barking in someone’s backyard. Some of these signs include a pet having poor body condition, being chained up or caged constantly or acting overly violent. While it’s important to protect animals, some neighbors can be overzealous in their accusations. If you are falsely accused of animal abuse, you may have to pay costly legal expenses and suffer a tarnished reputation.

What To Do After an Animal Cruelty Accusation in Atlanta

If you’ve been charged with animal cruelty or neglect, your first step should be immediately contacting an experienced Atlanta criminal defense attorney for legal representation. Unfortunately, these cases often garner unwanted media attention. Therefore, dealing with the legal proceedings involved in the case as quickly as possible is the best way to avoid a reputation being negatively impacted.

At Andersen, Tate, & Carr, our attorneys are experienced in handling animal cruelty cases and   have successfully handled a broad range of cases. We are available for free consultations to discuss the details of your case and give you options.

One Example of Our Success in Atlanta Area Animal Cruelty Cases

Even high profile athletes can’t escape false accusations of animal cruelty. In 2007, former Atlanta Falcons defensive tackle, Jonathan Babineaux, was arrested on a charge of felony animal cruelty. After he was accused, Babineaux contacted our team. Atlanta animal cruelty attorneys Pat McDonough and Trinity Hundredmark successfully defended Babineaux, and his felony animal cruelty charge was dropped based on self-defense.

This successful result would not have been possible without McDonough and Hundredmark conducting an extensive investigation. They spent hours interviewing both lay and expert witnesses, and they ultimately put together the sequence of events that led up to the dog attacking Babineaux’s infant child. They successfully concluded that Babineaux was acting legally and defending his child’s life.

Through this thorough investigation, McDonough and Hundredmark were able to prove the State’s case was based on a false scientific premise. As a result of their hard work, the charges were dropped prior to an indictment. This allowed Babineaux to avoid a tarnished reputation and helped him sign a new multi-million dollar contract with the Falcons later that year.
