There are three different degrees of arson charges in the Georgia Code of Law with varying degrees of severity in terms of punishments. Arson in the third degree occurs when a person unlawfully causes, aids or encourages damages to personal property with a value of $25 or more. A charge of second degree arson indicates that an individual knowingly caused damage to another person’s home, building, vehicle, or any other structure by means of fire or explosives. A person convicted of second degree arson can be fined up to $25,000 and can spend up to 10 years in prison.

A charge of first degree arson indicates that an individual knowingly caused damage, with fire or explosives, to an occupied or unoccupied dwelling, building or vehicle that could endanger human life. Also, if the fire is used to damage a building or vehicle that is insured against fire damage also qualifies as first degree arson. A person convicted of this level of arson can be fined up to $50,000 and can spend up to 20 years in prison.
